Court Reveals High Level Trump Regime Conspiracy To Falsely Smear Public Servant As A Criminal
A Judicial Determination Of Knowing Lies And “State Sanctioned Intimidation”
Before a coordinated campaign of lies led to her firing Mary Comans was an “exemplary public servant” working for FEMA. In facts stipulated in court (you can read the court ruling HERE) she was “a knowledgeable and highly skilled professional” who “worked tirelessly to further the crucial mission of FEMA on behalf of the American people,” and “was promoted under the leadership of both political parties” as a “a nonpartisan subject matter expert.” Her career came to an end when:
“For reasons unfathomable to this Court, officials chose to turn the power of the federal government against a singular employee with an impeccable record of public service . . . Ms. Comans was professionally targeted and personally attacked by government officials for no legitimate reason. The attacks against Ms. Comans were based entirely on false information, and many government officials knew the accusations were untrue at the time they were made. With no regard for the truth and with no consideration for the personal and professional effect on Ms. Comans, government officials exploited their access to mass media outlets to broadcast false information. These false statements reached hundreds of millions of people.”
Stunningly, the Trump Regime effectively admits to all of this. As the court’s decision made clear, “the Court is not called upon to resolve factual disputes between the parties” because the government did not object to any of the facts as asserted by Ms. Comans. These stipulated facts established “that high-ranking government officials, including then Secretary of DHS Kristi Noem and Elon Musk, engaged in a coordinated public relations campaign to impugn the personal and professional integrity of Ms. Comans.”
The conspirators falsely claimed that Comans circumvented a Trump executive order that paused federal funding to non-governmental organizations providing services to illegal or removable aliens. The EO was ambiguous as to whether the pause extended to state and local governments. However, that decision was above Comans’ pay grade, and she did not make it. The uncontested facts are:
Ultimately, the agency’s decision was that payments should continue to state and local governments. This decision was explicitly approved by employees of the newly created Department of Government Efficiency (DOGE) who were embedded with DHS and were reviewing and approving all funding initiatives. As a result of DOGE’s approval, Ms. Comans was directed to continue payments to state and local governments. Thereafter, other DOGE employees embedded with the Department of Treasury claimed FEMA’s payments to state and local governments violated the President’s Executive Order. What followed was a series of finger pointing and backtracking that resulted in the decision to blame Ms. Comans and three other career officials. On February 11, 2025, Ms. Comans was fired and DHS and DOGE officials began their public campaign to use her as a scapegoat.
In this coordinated campaign of lies the conspirators smearing Comans did not hold back. A DHS press release announcing her firing described Comans as a “deep state activist” who had “undermined the will and safety of the American people.” In the words of the court:
“The Government concedes . . . this statement was entirely false. The Government further concedes and the Court further finds that officials at FEMA and DHS knew this statement was false at the time it was made.”
The malicious campaign of lies was unrelenting. A DHS spokesperson, in an interview with the New York Times, accused Coman of “circumventing leadership to unilaterally make egregious payments for luxury N.Y.C. hotels for migrants.” Once again the government conceded this claim “was entirely false.” and the government further conceded “officials at FEMA and DHS knew the statement was false at the time it was made.”
This statement, that officials knew the statements were false at the time the statements were made, is repeated again and again throughout this 8 page court decision. In addition to legitimate outlets, like the New York Times, the court recounts the statements were made to MAGA social media trolls, with large followings, including Benny Johnson and Laura Loomer. The knowingly false statements were made by Kristi Noem, Corey Lewandowski, Elon Musk and various official spokespersons.

To his nearly quarter billion followers Elon Musk posted a picture of Comans and accused her of a “criminal action” “for funneling $58M to illegal migrant hotels in Manhattan.”
Once again the judge noted that the government conceded “that Mr. Musk and officials at FEMA and DHS knew this information was false at the time it was posted.” The judge went on to say that, “Posting Ms. Comans’ picture served no legitimate governmental interest and was little more than state sanctioned intimidation.”
Ms. Comans sued to clear her name. It is even called a “name-clearing hearing.” The judge acknowledged the federal courts were not the normal venue such name-clearing hearing but stated that:
“given the outrageous government conduct, including by those at the highest levels of DHS, in knowingly spreading false information about Ms. Comans, it is essential that this process be conducted by an independent judicial officer and memorialized in an Order of the Court.”
The judge concluded with the following summation of that outrageous conduct:
Armed only with false statements, high-ranking government officials undertook a premeditated campaign to impugn the personal and professional integrity of Ms. Comans, a nonpartisan, career public servant. Their intent was to disseminate false and derogatory information about Ms. Comans as widely as possible. To be clear, it was the stated position of the United States Government that Ms. Comans acted in a criminal manner with a criminal intent. That is untrue. Ms. Comans was publicly accused of knowingly and “egregiously” misspending federal funds. That is untrue. She was accused of laundering “forbidden funding.” That is untrue. She was accused of willfully violating a Presidential Executive Order, the orders of the DHS Secretary, circumventing leadership, and frustrating the will of the American people. That is untrue. She was accused of undermining public safety. That is untrue . . . the Court finds that the derogatory statements about Ms. Comans were objectively and demonstrably false, that many high-ranking government officials made these statements knowing they were false.”
The court then granted the only feeble relief it could offer in this proceeding, declaring: “Ms. Comans’ name is ADJUDGED CLEARED.”

One would hope that more meaningful justice might be available via a defamation lawsuit for a case as egregious as this. However, libel and slander are specifically barred from lawsuit under the Federal Torts Claims Act. Thus, the government of the United States cannot be sued for defamation. Sovereign immunity makes justice more near sighted than blind, at least in regards to the government. As for suing people individually, the Westfall Act affords federal employees broad immunity to civil suits if the Attorney General certifies their actions were within the scope of their employment. All that could make a defamation lawsuit challenging and lengthy.
However, it does create some interesting issues for Elon Musk. In various court filings the government has denied that Musk was the head of DOGE or even a government employee. However, this court decision describes Musk as “a Special Government Employee and head of DOGE.” However, it also states his, “Posting Ms. Comans’ picture served no legitimate governmental interest and was little more than state sanctioned intimidation.”
Beyond future legal action, that high level government employees engaged in premeditated conspiracy to knowingly lie in accusing an innocent federal employee of criminal conduct should be a major scandal. It should be big news with multiple firings at high levels of the Department of Homeland Security and individuals associated with DOGE. Elon Musk should be condemned for the malicious liar a court has proven him to be, and barred from government service.
However, America has become desensitized to the routine corruption of the Trump Regime. This court’s decision has barely made a blip in national news reporting, and the Trump Regime just elevated Elon Musk to a leadership role in “Project Meridian,” a Pentagon task force to study the future of automated weapons.
It is sometimes difficult to describe how evil Elon Musk, DOGE and the Trump Regime are. The story of Mary Comans illustrates the soulless depravity to which these people, and this administration, will sink. Such is the reality of America today.
